Return and Refund Policy
  1. The provisions and prices in this Contract will be in effect for ninety (90) days from date the initial deposit is received.Within these ninety (90) days, Borga, Inc. must receive a completed, signed Release Form along with the fabrication deposit (if applicable), as a confirmation that the customer has approved the structural documents. No changes by customer of any kind will be accepted after Borga's receipt of the signed Release Form and the fabrication deposit (if applicable).
  2. If the provisions in item 1 are not met, Borga, Inc. reserves the right to adjust provisions and prices in this Contract.
  3. Upon receipt of the signed Release Form and fabrication deposit (if applicable), Borga, Inc. will schedule the building for fabrication. The customer will have thirty (30) days after this scheduled completion date to take possession of the building materials, up to a maximum of 90 days after receipt of the signed Release Form unless otherwise notified by Borga, Inc.
  4. If the provisions in item 3 are not met, Borga, Inc. reserves the right to adjust provisions and prices in this Contract.
  5. The Contract is valid for no more than one year from date the initial deposit is received.
  6. All deposits are non-refundable.
  7. Structural calculations and steel erection drawings based on the specifications indicated in this Contract are included as outlined in the Agreement. Architectural, electrical, plumbing etc. services may be required and shall not be provided by Borga, Inc.
  8. The building price includes optional items, accessories, factory located openings etc. only to the extent expressly evident by this Contract. Anchor bolts are not included. Installation and erection, inspection services are not included as part of this Contract.
  9. Borga, Inc. is responsible for fabrication (and related structural calculations and drawings) only, and the buyer is responsible for all other ancillary requirements and actions, including but not limited to building code requirements, applicable permits, installation, erection, foundation and anchors.
  10. Changes to this Contract can only be made by use of a written Change Order, clearly outlining the changes to this Contract. Any Change Order must be mutually agreed upon and properly endorsed by the buyer and Borga, Inc.
  11. The Contract shall include the Borga, Inc. Sales Terms, which are incorporated herein by this reference.
  12. Title passes at time and place of shipment unless otherwise specified. Any claims shall be made in writing no later than 15 days from shipment date. All sales are final, and no returns will be accepted.
  13. Any disputes arising from this Contract or any Amendments or Change Orders thereto shall be governed by California Law and resolved by the state or federal courts in Fresno County California and the parties hereto waive all claims regarding inconvenient County, California, forum with respect to such courts.
